Terms of Use
These terms govern your use of the HushNest app and its online service, published by Diatomic Soft ("we", "us"). By downloading or using HushNest you agree to them. If you do not agree, please do not use the app.
1. What HushNest is
HushNest plays soothing sounds, mixes and bedtime routines for parents and caregivers. It is a comfort tool, not a medical device, and it does not diagnose, treat or prevent any condition or guarantee sleep. Always follow safe sleep guidance from your healthcare provider. Keep your phone out of the sleep space, and play sounds at a low, safe volume and distance.
2. Your use of the app
- You must be old enough to form a binding agreement where you live, or use the app with the permission of a parent or guardian.
- We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes.
- Do not copy, redistribute, resell or extract the sounds, artwork or app content; reverse-engineer the app except where the law allows; interfere with the service; or use it unlawfully.
3. Accounts
An account is optional. If you sign in with Google or Apple, keep access to that account secure; you are responsible for activity under it. You can delete your account at any time in the app or at hushnest.diatomicsoft.com/account/delete.
4. HushNest Plus and purchases
- Plus unlocks additional sounds and scenes, unlimited saved mixes, blended mixes and removes ads. It is available as a monthly or yearly subscription, or as a one-time lifetime purchase. The exact content included may be listed in the app.
- Ad-free (Android) is a one-time purchase that removes ads only; Plus content stays locked.
- Prices are shown in the app and in the store before you buy, and may vary by country and change over time.
- Payments are handled by Google Play or the Apple App Store under their terms. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal in your Google Play or App Store account settings. Cancelling stops future renewals; access continues until the end of the paid period.
- Refunds are handled by Google Play or Apple under their policies, except where the law requires otherwise.
- Purchases are tied to your store account. Use Restore purchases in the app to restore them on a new device. Deleting your HushNest account does not cancel a subscription.
5. Ads
The free Android version may show banner ads provided by Google AdMob, as described in our Privacy Policy.
6. Content and ownership
The app, its design, artwork, animations and sound selection are owned by Diatomic Soft or its licensors. Some sounds and fonts are provided under third-party licences, credited in the app where required. Nothing in these terms transfers ownership to you.
7. Changes and availability
We may update, add or remove features and content, and we may suspend or end the service. We will try to give reasonable notice of significant changes that affect paid features. If you are signed in, keep an export of your library if it matters to you.
8. Disclaimers
The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including fitness for a particular purpose and uninterrupted or error-free operation. Some jurisdictions do not allow these exclusions, so they may not fully apply to you.
9. Limitation of liability
To the fullest extent the law allows, Diatomic Soft is not liable for indirect, incidental, special or consequential damages, or for loss of data, arising from your use of the app. Our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your statutory consumer rights.
10. Ending these terms
You can stop using the app at any time. We may suspend or end your access if you seriously breach these terms. Sections 6, 8, 9 and 11 continue after termination.
11. Governing law
These terms are governed by the laws of Bangladesh, without affecting any mandatory consumer protection laws of the country where you live.
12. Changes to these terms and contact
